Terms and Conditions of Sale

These Terms apply to the supply of training courses, equipment sales, equipment servicing, testing, and related services by BHB Safety Specialists Ltd.

1. Definitions

“Company” refers to BHB Safety Specialists Ltd.
“Customer” refers to any individual or organisation purchasing goods or services from the Company.
“Services” refers to training, inspection, servicing, consultancy, testing, or other services provided.
“Goods” refers to equipment or products supplied.

2. Orders and Acceptance

All orders placed with the Company are subject to acceptance.

Acceptance occurs when:

  • written confirmation is issued, or

  • goods or services are supplied.

The Company reserves the right to decline any order.

3. Pricing

All prices are:

  • subject to change without notice

  • exclusive of VAT unless stated otherwise

  • exclusive of delivery charges where applicable

Quotes are valid for 30 days unless otherwise stated.

4. Payment Terms

Payment terms are 30 days from invoice date unless otherwise agreed.

The Company reserves the right to:

  • require payment in advance

  • suspend services or delivery where accounts are overdue

Interest may be charged on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

5. Training Courses

For training bookings:

  • course places are only confirmed upon receipt of booking confirmation or payment

  • joining instructions will be issued prior to the course

Customers must ensure that delegates:

  • meet any course prerequisites

  • are medically fit and capable of undertaking practical training where applicable

  • follow all safety instructions given by instructors

The Company reserves the right to remove any delegate who fails to comply with safety instructions.

6. Course Changes

The Company reserves the right to:

  • change course dates

  • change course venues

  • substitute instructors where necessary

Customers will be notified as soon as reasonably practicable.

7. Equipment Sales

All goods supplied remain the property of the Company until paid for in full.

Risk in the goods passes to the customer upon delivery.

Customers must inspect goods upon receipt and notify the Company of any damage or shortages within 48 hours.

8. Equipment Servicing and Inspection

Servicing and inspection services are carried out:

  • by competent personnel

  • in accordance with relevant standards and manufacturer guidance where applicable.

Inspection reports or certificates will be issued where relevant.

The Company is not responsible for equipment failures arising from:

  • misuse

  • modification

  • damage occurring after inspection.

9. Limitation of Liability

To the fullest extent permitted by law, the Company's liability for any claim shall not exceed the value of the goods or services supplied.

The Company shall not be liable for:

  • indirect loss

  • consequential loss

  • loss of profit

  • loss of business

Nothing in these terms limits liability for death or personal injury caused by negligence.

10. Force Majeure

The Company shall not be liable for delays or failure to perform obligations due to circumstances beyond its reasonable control, including:

  • extreme weather

  • transport disruption

  • industrial disputes

  • government restrictions.

11. Cancellation

Cancellation terms may vary depending on the service booked and will be provided at the time of booking.

Terms and Conditions of Hire

Effective Date: 11/03/2026

These Terms and Conditions (“Agreement”) govern the hire of equipment (“Equipment”) from BHB Safety Specialists Ltd (“we”, “us”, or “our”) to the customer (“you”, “your”).

By hiring Equipment from us, you agree to be bound by these Terms and Conditions.

1. Hire Period

1.1 The hire period begins on the date the Equipment is delivered to you or collected by you and ends on the date the Equipment is returned to and accepted by us.

1.2 Any extension of the hire period must be agreed in writing and may incur additional charges.

1.3 Equipment returned after the agreed hire period may be subject to additional hire charges.

2. Hire Charges & Payment

2.1 Hire charges are as per the rates quoted or agreed and must be paid prior to or on the date of hire, unless otherwise agreed in writing.

2.2 Additional charges may apply for:

  • late return of Equipment

  • cleaning

  • repair or replacement of damaged Equipment

  • loss or theft

2.3 All prices are exclusive of VAT, which will be charged at the prevailing rate.

3. Deposits

3.1 A security deposit may be required before Equipment is released.

3.2 Deposits will be refunded upon safe return and inspection of the Equipment, less any deductions for:

  • damage

  • loss

  • excessive cleaning

  • overdue hire charges

3.3 Payment of a deposit does not limit your liability for loss, damage, or replacement costs.

4. Delivery & Collection

4.1 Delivery and collection services may be provided at an additional cost.

4.2 You are responsible for ensuring that a suitable person is available to receive or return the Equipment.

4.3 Risk and responsibility for the Equipment passes to you upon delivery or collection, whichever occurs first.

4.4 We reserve the right to charge a reasonable amount for Equipment that is not collected as agreed, not exceeding the value of the accepted quotation.

5. Use of Equipment

5.1 Equipment must only be used:

  • for its intended purpose, and

  • by competent and suitably trained personnel

5.2 You must not:

  • modify or alter the Equipment

  • remove labels, serial numbers, or safety markings

  • tamper with safety devices

5.3 Equipment must not be sub-hired, loaned, or transferred to any third party without our prior written consent.

6. Maintenance and Care

6.1 You must inspect the Equipment upon receipt and prior to use and notify us immediately of any defects.

6.2 Equipment must be kept clean, secure, and in good condition during the hire period.

6.3 You will be responsible for the cost of any repair, replacement, or cleaning required due to misuse, neglect, or damage occurring during the hire period.

7. Loss, Theft or Damage

7.1 You are fully responsible for the Equipment during the hire period.

7.2 Any loss, theft, or damage must be reported to us immediately.

7.3 You will be liable for the full replacement value of any Equipment that is:

  • lost

  • stolen

  • irreparably damaged

8. Liability

8.1 To the fullest extent permitted by law, we shall not be liable for any indirect or consequential loss, including loss of business, loss of profits, or delays arising from the use or inability to use the Equipment.

8.2 Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot legally be excluded.

9. Insurance

9.1 You are responsible for ensuring that the Equipment is adequately insured against loss, theft, or damage for its full replacement value during the hire period.

10. Termination

10.1 We reserve the right to terminate the hire agreement immediately if you breach these terms.

10.2 Upon termination, the Equipment must be returned to us immediately at your cost.

11. Ownership

11.1 All Equipment always remains the sole property of BHB Safety Specialists Ltd.

11.2 Nothing in this agreement transfers ownership of the Equipment to you.

12. Governing Law

12.1 These Terms and Conditions are governed by and construed in accordance with the laws of Northern Ireland.

12.2 Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
